There are often conditions attached to planning permissions that need further details to be submitted and approved by the council at certain stages of the development.
This additional information must be submitted to us for formal agreement - known as 'discharge of conditions.'
When planning permission is granted subject to conditions, it's the responsibility of:
- the applicant, or
- any subsequent developer
to make sure that the terms of all conditions are met in full. The conditions will outline specific points in your development when details should be submitted to us for approval.
- Pre-commencement conditions: These conditions need to be formally discharged before construction and/or development starting on site.
- Pre-occupation conditions: These conditions need to be formally discharged before the development being occupied.
We aim to deal with discharges of conditions as quickly as possible. This is to enable applicants to start or progress works on site promptly.
Please note that your application will be assessed based on the information provided at the time of submission. If the information is not acceptable the application will be refused and a new application will be required.

Electronically via the Planning Portal
Planning Portal is a service to submit planning applications electronically. Registration is easy and you can complete your application form, upload supporting documents and pay fees online.

Fees
The appropriate fee must be included with your application.
You will be charged again if:
- you want to revise details already approved for discharge of conditions or
- a refusal to discharge has been issued
There is no “free go” for these submissions.

Charges for more than one condition to discharge
You won't have to pay a fee for each condition. A fee is only charged for each request.
If you apply to discharge all the conditions at once, you will only be charged one fee.
If you send in details for each condition separately, these will be counted as separate applications. You will have to pay separate fees.
Exceptions to the charges
The following condition applications are free:
- Requests relating to advertisement consents
- Requests relating to listed building consent
- Requests relating to tree preservation orders
What happens if I do not discharge my conditions?
Without formal approval, it may lead to formal enforcement action by the Council. This could affect the future sales of the property.
Some conditions must be approved before commencement of development.
Proposed samples of materials
Please do not submit proposed samples of materials. Photographs, brochures or detailed product specifications should provide enough detail for assessment. If samples are required, your case officer will arrange an appointment to view.
