In order to assist residents and to allow me to fulfil my role as an Elected Member, I need to collect, store, use, share and dispose of personal data. This is called data processing. When I process your personal data I must comply with data protection legislation. This privacy notice explains how I will use your personal data as an Elected Member of Cornwall Council.
What information is collected?
The information I collect from you will include details of the issues you have raised with me, your name, address and other contact details as well as any other personal information required by the Council or Group of Companies service linked to your enquiry. The personal data you provide may also include special category information about you or a third party if, for example, you raise an issue relating to a service provided by Social Work or the NHS, i.e. social care, health or medical information.
Why is this information needed?
Your information is being collected to support my role as an elected member, e.g. to allow me to undertake case work on behalf of individual residents and to represent the interests of my division.
The lawful basis for collecting your information in most circumstances will be public task and substantial public interest. This is where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in me/the Council.
Who will I share your information with?
It is very likely that I will need to share your personal data with a Council or Groups of Companies officer and I may have to share it with other Elected Members to address wider divisional concerns. I will not share any personal data which is not connected with a resident’s case.
I may need to pass your personal details and the circumstances of your query/complaint to third parties so that they can look into the matters you have raised. These third parties include:
- town and parish councils and other councils
- government agencies
- public bodies
- health trusts and regulators
- voluntary sector and community organisations that the Council works with
- police or other law enforcement agencies
Where a Council or Group of Companies service becomes involved in dealing with the issue you have raised, they will have service specific privacy notice relative to their activities available on the Council’s website.
Your data will be held within Cornwall Council’s secure network and premises and will not be processed outside of the UK, the EEA or within a country without adequacy status under UK GDPR.
How long will I keep your information?
I will keep your personal data for as long as I need it to fulfil my obligations in assisting you, and to comply with any legal requirements for keeping certain types of data.
Your rights
Subject to various exceptions and limitations, you have rights about your data, including:
- the right to access your information, you can ask for copies of information I hold about you
- the right to have your information erased and have inaccuracies rectified
- the right have restrictions placed on the use of their data
- the right to be informed about the use of your data and not to be subject to decision-making solely by a machine

What if I don’t agree with something?
I would prefer any complaints to be made to me initially so that I have the opportunity to see if I can put things right.
