This guidance outlines how organisations can formally request personal data from Cornwall Council under the exemption provided by Schedule 2, Part 1(2) of the Data Protection Act 2018.

Important notes
- Requests must relate to the prevention or detection of crime, or the apprehension or prosecution of offenders.
- Eligible organisations include (but are not limited to): Police, HMRC, other Local Authorities, and Public Bodies acting under statutory powers.
- Submission of a request does not compel the Council to disclose information. Each request is assessed on its merits and may be refused.
Section 1: Requester Details
- Provide the following:
Full name, job title, and organisation
Contact details including postal address, secure email, and telephone number
This information helps verify your authority to make the request.
Section 2: Data Subject Details
Include:
- Specific details of the personal data you are seeking
- Any known identifiers to help locate the data
- Attach supporting documents if available, and tick the attachments box on the form
Section 3: Justification for Disclosure
You must:
- Detail the alleged offence (or tick the box if disclosure would prejudice the case)
- State the statutory powers under which you are requesting the data
- Explain why the information is necessary to your investigation
Note: Requests must relate to a specific individual. General or speculative requests ("trawling") will be refused.
Section 4: Authorisation and Declaration
The request must be authorised by a Police Inspector or higher, or a Senior Manager for other relevant bodies.
Section 5: Information Provision
Indicate your preferred method of receiving the data:
- Secure email is the preferred and fastest method
If collecting in person, bring valid ID (e.g., warrant card or ID badge)
