Other actions arising from meetings

With effect from the Council’s Annual General Meeting in May 2024, the Council will also track other actions arising during meetings.

Actions include commitments made by Members (e.g. Leader, Portfolio Holder or Chairman of a Committee) to:

  • provide a written response to a question that cannot be answered at the meeting in question,
  • write to Government/individuals/other persons as a result of a decision/request, or
  • undertake other actions

Motion Cornwall Council says it values trial by jury

Action - It was resolved that this Council

i) Mandates the Leader to write to the Home Secretary at their earliest convenience, condemning the Government's plans to massively restrict the ancient right to trial by jury.

ii) Affirms Cornwall Council's support for trial by jury and its civic value to Cornish communities.

iii) Writes to the Lord Chancellor and Secretary of State for Justice, and to Cornwall's Members of Parliament, setting out this Council's position.  As well as urging the safeguarding of jury trials as a fundamental component of the justice system.

iv) Asks the Leader and the relevant Cabinet Member to work with Communications to publish a short public statement.  This will recognise the contribution of jurors and signposting official information about jury service.

Motion Cornwall Council Supports Retail, Hospitality and Leisure Business in Cornwall

Action - It was resolved 

  1. That this Council mandates the Leader to write to the Chancellor to point out the devastating impact her measures, announced in the Autumn Budget 2025, will have on Cornwall's Retail, Hospitality and Leisure (RHL) sector.
  2. That this Council opposes specific measures in the Autumn Budget 2025, which relate to RHL businesses in Cornwall, and requests the Government to:
    (a) Reverse its decision to end existing Retail, Hospitality and Leisure (RHL) business rates relief (40% up to a cash cap per business) on 31 March 2026. The consequence of the current policy will mean that many businesses will face higher bills.
    (b) Consider increasing the business rates discount for hospitality to the full 20p permitted in legislation.
    (c) Commit to delaying business rates revaluation levels for hospitality businesses and freeze them at 2023 levels.
    (d) Acknowledge that whilst the Government has introduced lower business rates multipliers for RHL properties, this is a significantly less generous policy than the previous 40% relief for many businesses.
    (e) Accept that a Transition Relief Scheme only applies to a limited number of businesses. It slows the increase rather than reducing the overall tax burden RHL businesses will face. 
    (f) Implement a 5% reduction in VAT on Retail, Hospitality and Leisure Businesses.
  3. That this Council recognises the significant social, economic and cultural contribution that Retail, Hospitality and Leisure businesses provide in Cornwall, including:
    (a) 49,200 job and career opportunities in the RHL sector in Cornwall alone.
    (b) RHL GVA in Cornwall totals £1.35 billion annually.  Highlighting this sector as a significant economic driver locally.
  4. That this Council urgently takes action to review the measures announced in the Autumn Budget 2024.  It provides an assessment on their likely impact on the Retail, Hospitality and Leisure sector.
  5. That this Council provides and publishes clear guidance on its website on how businesses affected can mitigate these measures and be supported during this difficult time.
  6. That officers do not take any action on this decision until Government confirms its position.

Motion Cornwall NHS Dentistry

Action - In accordance with Council Procedure Rule 12.4, the Chairman referred the motion to the Cabinet as the subject matter was one coming within its functions.

Action - Councillor Rogerson to arrange to meet with Councillor Parsons on site (with other interested parties) to discuss the proposals.

Tideford Proposed Parking Charges

Action - Councillor La Broy to provide a written response to Councillor Magowan on the number of tenants in receipt of housing benefit.

Informal Investment Panel

Action - Further to his undertaking at the Council's Annual General Meeting in May 2025, Councillor Frost to provide a written reply to Councillor Donnithorne in relation to his query about the potential reinstatement of the former Informal Investment Panel, or an alternative arrangement.

Community Infrastructure Levy (CIL)

Action - Councillor Preece to provide a written reply to Councillor Mustoe on the number of applications received in relation to CIL funding and the deadlines involved.

Wind Turbine - Tregony

Action - Councillor Rich to meet with Councillor German on the potential deployment of a wind turbine at Tregony.

St Piran's Day

Action - Consideration to be given to avoiding St Piran's Day in the schedule of meetings in future years.

Motion Review of Admissions Policy: Fair Access for Mevagissey Families to Secondary School Transport

Action - It was resolved that Cabinet is requested to:

(i) Update Cornwall Council's admissions policy to make Penrice and Poltair Schools joint designated schools for the current Penrice School and Poltair designated areas, thus allowing pupils from Mevagissey fair access to school transport; and

(ii) in carrying out (i), take the opportunity to review the wider policy to ensure other rural communities are not being adversely affected in the same way.

Motion Cornwall Dentistry

Action - It was resolved that Cornwall Council calls on our Director of Public Health, to:

(a) Identify schools not engaged in oral health preventative programmes, including those declining participation and set out action to increase uptake, and exploring extending supervised toothbrushing through family wellbeing hubs.

(b) Work with partners, including Smile Together, to expand the dental van and establish dental nurse led check-up and referral pathways into NHS services.

(c) Investigate initiatives to encourage local students into dentistry and support their return to practise in Cornwall.

(d) Ensure all Looked After Children are registered with an NHS dentist and receive a check-up within six months of entering care.

Motion Communities Must Not be Overlooked

Action - It was resolved that

(i) this Council notes that 379 areas across the United Kingdom have been allocated a share of £5.8bn government funding through the government's 'Pride in Place' programme, and not one of them is in Cornwall - despite longstanding and widely recognised issues of deprivation in Cornish communities.

(ii) This Council notes the numerous reports highlighting that deprivation in rural regions in particular can be hidden and/or ignored by virtue of the measures and formulas government uses to determine and address deprivation.

(iii) This Council condemns this failure and mandates the Leader to write to Secretary of State for Housing, Communities and Local Government to point out the very real issues of deprivation in Cornwall and requests the Government to:

a) Publish the rural proofing assessment of the Pride in Place programme

b) Review its approach to regeneration funding through schemes such as Pride in Place

c) Work with Cornwall to establish a bespoke funding scheme that empowers and provides tailored support to tackle deprivation in Cornish communities.

d) Reform resource-allocation formulas to more accurately reflect deprivation in a rural context, through use of LSOA-level data, multi dimensional deprivation profiles that reflect the realities of rural living, and recognise the higher per capita costs of rural service provision.

(iv) Cornwall Council engages with the LGA to help advise government on pride of place and neighbourhood investment.

Motion Public Realm Weed Treatment Programme: Requirment for Public Consultation

Action - It was resolved that Cabinet is requested to:

  1. Recognise that the decision to reintroduce chemical weed treatment using glyphosate represents a significant policy reversal with ecological, public health and democratic implication for communities across Cornwall.
  2. Pause the commencement of chemical weed treatment currently scheduled for May 2026 until a meaningful public consultation process has been completed.
  3. Undertake their tidy ups and tackling of structural defects within existing policy, explicitly that glyphosate shall not be used except for the control of Schedule 9 invasive plants.
  4. Recognise the wholly inadequate three week opt out window provided to parish and town councils which included Easter and commits to extending this to 30 days after the public consultation results have been published.
  5. Give town/parish councils more clarity on the minimum required standards of the urban network.
  6. Urgently review the financial terms of the opt-out scheme, which as currently structured are coercive: town and parish councils that exercise their democratic right to refuse glyphosate treatment are penalised by the simultaneous removal of wider targeted estate improvement works, and are offered funding covering only the chemical treatment element (£343.45 per km), leaving them to bear the full additional cost of alternative weed management,  waste clearance and public liability insurance from their own precept. Decouple the opt-out from the loss of estate improvement funding.
  7. Pending completion of the public consultation and Cabinet's consideration of its outcome, no significant additional expenditure, capital investment, or long-term contractual commitment related specifically to glyphosate use or application methods be entered into.
  8. Request officers to design and carry out limited, locally controlled trials of non-glyphosate weed control methods on representative sites, with clear cost, effectiveness and safety data reported to Cabinet alongside the consultation outcomes.

Non-Disclosure Agreements (NDAs)

Action - The Leader to review all NDAs made in the last Council and withdraw any delegations to make NDAs by officers without political sign-off.

Motion Mental Health and Wellbeing in Schools

Action - It was resolved that Cabinet is requested to:- 

  1. Set up an informal Cabinet Advisory Group to consider the matter of mental, emotional health and wellbeing in primary and secondary schools and colleges in Cornwall.
  2. Following completion of its work write to the Secretary of State for the Department for Education with its findings and asking for their support in tackling any issues that are found.

Motion Protecting Freedom of Expressing and Fair Process within Cornwall Council

Action - It was resolved that the Standards Committee is requested to:

1. Note that the Government has indicated its intention to introduce a mandatory national Code of Conduct for local authorities, which councils will be required to adopt without local variation. 

2. Affirm unequivocally that freedom of expression is a fundamental right protected under:

• Article 10 of the European Convention on Human Rights (ECHR), as incorporated into UK law by the Human Rights Act 1998; and

• the common law tradition of free speech as a cornerstone of democratic governance.
• Nothing in this motion shall be interpreted as permitting or protecting conduct that amounts to unlawful harassment, discrimination, or other behaviour prohibited under the Equality Act 2010 or related legislation.
3. Recognise that elected members, council officers, and members of the public must be able to engage in lawful, robust, and even controversial debate without fear of improper sanction, provided such expression remains within the law.
4. Further note concerns that, irrespective of the wording of any Code of Conduct, the process by which alleged breaches are assessed and investigated may, if not properly safeguarded, be used in a manner that has the effect of discouraging or penalising lawful political expression.

5. Clarify that this motion does not seek to pre empt, amend, or conflict with any future nationally prescribed Code of Conduct, but instead relates to the procedures, thresholds, and safeguards applied by the Council when assessing and determining alleged breaches.

6. Request the Monitoring Officer to prepare and bring forward draft interim guidance for consideration and approval by the appropriate committee or Full Council within three months, pending completion of the review set out below, to ensure that:

• Conduct processes cannot be used for complaints lacking a reasonable prospect of establishing a breach of the code, including those unsupported by evidence, or which appear to constitute a misuse or weaponisation of the complaints process, appear to be politically motivated, vexatious or trivial;

• Thresholds for initiating any investigation explicitly protect lawful political expression;

• Any complaints relating to speech are subject at the earliest stage to an assessment consistent with Article 10 ECHR, including the principles of legality, necessity, and proportionality; and

• Such guidance shall have effect as soon as practicable, unless and until superseded by revised procedures.

7. Resolve to initiate an urgent review of the Council’s complaints handling procedures, assessment thresholds, and investigatory processes relating to alleged breaches of the Code of Conduct, to be completed within six months, with the objective of ensuring that:

a) No councillor is subject to investigation or sanction solely for expressing lawful political views, however robust or controversial;

b) Political disagreement or lawful criticism does not in itself trigger formal misconduct proceedings;

c) A high threshold is applied before any formal investigation is commenced, including an effective initial filtering stage to dismiss complaints lacking a reasonable prospect of establishing a breach of the code, including those unsupported by evidence, or which appear to constitute a misuse or weaponisation of the complaints process, appear to be politically motivated, vexatious, or trivial;

d) Any restriction on expression through process or outcome is demonstrably lawful, necessary, and proportionate in line with Article 10 ECHR;

e) The complaints and investigatory process cannot be used, whether intentionally or inadvertently, as a form of punishment in itself;

f) Any complaint involving expression includes a mandatory written assessment, prior to any escalation or sanction, explicitly addressing:

• whether the expression is protected under Article 10 ECHR; and
• whether any proposed action is lawful, necessary, and proportionate.

8. Resolve that no councillor shall be required to endorse or affirm any specific political or ideological position as a condition of training, and training for councillors should remain focused on legal compliance, standards, and professional conduct.”

9. Resolve that the principles and procedural safeguards set out in this motion are intended to guide the Council’s approach to the fair and lawful handling of conduct matters, and that:

• These principles shall inform the development and application of procedures, but shall not prevent Full Council from amending, replacing, or departing from them where it considers it appropriate and lawful to do so; • Any future changes to procedures should include a clear explanation of their anticipated impact on freedom of expression and other relevant legal rights and duties;

• The Monitoring Officer shall provide advice on the compatibility of proposed changes with the Council’s legal obligations, including (but not limited to) those arising under Article 10 ECHR, the Human Rights Act 1998, and the Equality Act 2010;

• Procedures, guidance, and practices should be applied in a manner that is lawful, proportionate, and consistent with the Council’s wider statutory and public law duties; and

• In interpreting and applying these principles, due regard shall be had to the need to balance freedom of expression with the protection of others’ rights, the maintenance of public confidence, and the proper administration of the Council’s functions.

Concerns regarding CQC performance

Action - Chairman and Vice Chairman to write to Andrew George MP, noting his position as MP and as a Member of the Parliamentary Health and Social Care Select Committee to express concerns regarding CQC performance given the draft inspection report of Cornwall Council Adult Social Care is not yet available, six months after the inspection having taken place.
