Motion Abandoned Boats

Action - Cornwall Council commits to

1. Work with all Stakeholders to consider a means by which boat abandonment is distinctiveness and:

a. Clean up the hundreds of abandoned end-of-life boats around the coastline and estuaries of Cornwall and beyond.

b. Support and promote a viable means of recycling GRP and encourage manufacturers to use more sustainable materials for new boats.

2. Lobby Government to consider introducing tougher legislation to combat the increasing threat of abandoned vessels to our marine environment.

Response Maritime Manager Chris Jones is on a British Ports Association working group which are lobbying Government with regards to end of life boats.

Motion Supreme Court's Recent Clarification of the Equality Act

Action - In accordance with Council Procedure Rule 12.4, the Chairman referred the motion (Responding to the Supreme Court's Recent Clarification of the Equality Act) to the Cabinet as the subject matter was one coming within its functions

Response - At Council on 25 November 2025 as part of his Leader’s announcements, the Leader confirmed the following which is confirmed in the minutes:-

“The motion had requested an All-Member Briefing within four months of the meeting, outlining the changes being made in light of the ruling. The All-Member Briefing had originally been planned for early November, and would be rescheduled early in the New Year. The Equality and Human Rights Commission had explicitly stated that organisations and service providers should not wait for its updated statutory Code of Practice to comply with the law following the Supreme Court's ruling. The Commission had clarified that the ruling took immediate effect in law. Furthermore, in referring the motion to Cabinet, the Corporate Finance and Performance Overview and Scrutiny Committee had added the Council’s compliance with the Supreme Court ruling to its work programme. Members of the Committee would consider how the new draft EDI Strategy 2026–2030 aligned with the ruling, with two meetings to be arranged early in the New Year. These would provide an opportunity for Members to engage with and provide feedback on the new draft strategy ahead of making a formal recommendation to Cabinet.”

Motion Devolution for Cornwall

Action - It was resolved that Cornwall Council

  1. Reaffirms its call for a meaningful devolution settlement for Cornwall.
  2. Calls for this devolution settlement to properly reflect Cornwall's national identity and the national minority status of the Cornish.
  3. Calls for central Government to formally recognise Cornwall as one of the five nations of the United Kingdom.
  4. Mandates the Leader of Cornwall Council to write to the Prime Minister, the Deputy Prime Minister and other relevant ministers to seek a meeting with a cross-party delegation from this authority.

Motion Safeguarding Cornwall's Health Priorities

Action - It was Resolved that we are disappointed that this decision has been made nationally on behalf of Cornwall and would have been keen to see Cornwall & IOS ICB remain sovereign but look forward to working with the new board upon their appointment and that the Council:-

  1. Engages constructively with NHS England, the new ICB leadership, and the Secretary of State for Health to seek: A. Clear assurances and seek guarantees that Cornwall will retain **dedicated leadership representation** within the cluster. B. Transparent finding arrangements, ensuring Cornwall's budget is protected and used to address local health inequalities. C. A strong voice for Cornwall in strategic planning, with meaningful involvement of local authorities and communities and this remains central to the delivery of health and care services for residents in Cornwall. D. Ensure the residents of Cornwall continue to be heard through a revised and strengthened 'Healthwatch' provision.
  2. Requests a joint discussion with Devon County Council and the Isles of Scilly Council to explore collaborative governance arrangements that respect both systems' needs.
  3. Tasks the Health & Adult Social Care Overview & Scrutiny Committee with monitoring the transition, reporting on: A. Impacts on Cornwall's health services and outcomes. B. Community stakeholder engagement in decision-making. C. Financial and staffing stability during the merger process.
  4. Works with Cornish MPs and health leaders to ensure local concerns are heard at a national level, while seeking opportunities to strengthen, not diminish, health outcomes for all residents.

Motion the Provision of Hydrotherapy for Cornwall Wide Benefit

Action - in accordance with Council Procedure Rule 12.4, the Chairman referred the motion (Public Consultation on the Provision of Hydrotherapy for Cornwall Wide Benefit) to the Cabinet as the subject matter was one coming within its functions.

Response - at Council on 25 November 2025 as part of his Leader’s announcements, the Leader confirmed the following which is confirmed in the minutes:- “The Portfolio Holder for Tourism, Localism and Planning had met with the proposer and seconders of the motion and the Chairman of the Council on 12 August 2025.

In response to the motion, it had been agreed that, as this did not sit within Leisure or Public Health priorities, Cornwall Council should no longer take a lead on discussions nor lead a public consultation.

Instead, a proposal had been put forward that outlined a community-led model. Since then, a plan had been put in place with agreed milestones and timelines that prioritised financial viability and community leadership.

An exploration of alternative hydrotherapy solutions had also been enacted. Positive progress had been made to date, including engagement with potential providers and the community group invested in progressing a hydrotherapy provision in Mid Cornwall.

In addition, a survey had been issued to specialist providers and user groups to establish demand. Based on the responses, viability of the proposal could be assessed.”

Motion Banning of Plastic 'Flying Ring' Toys

Action - It was Resolved that Cornwall Council

  1. Promotes a Voluntary Ban on the sale of, 'Flying Rings', encouraging shops to sell alternatives instead.
  2. Produces and circulates publicity highlighting to the public the danger these toys present to marine mammals.
  3. Bans or discourages the use of, 'Flying Ring' toys on Cornwall Council beaches.

Recruitment process for the Fal and Helford SAC Estuary Officer

Action - Councillor Rich to provide a written response to Councillor German in respect of his query about the recruitment process for the Fal and Helford SAC Estuary Officer i.e. how the post had become vacant and the timescales for recruitment for the replacement.

Public Transport Links to Derriford

Action - Ahead of the bus contract review in 2028, Councillor Rogerson to discuss with Councillor Pascoe potential alternative transport options for the residents of Liskeard to access Derriford Hospital.

Action - Councillor Rich to confirm in writing to Councillor Mustoe the timescales for the reopening of the bridge.

Out of Court Settlements since May 2021

Action - The Leader to provide a written response to Councillor Magowan on the details of how many out of court settlements the Council has entered into since May 2021, how many of these included confidentiality clauses, the total value of the agreements and, without disclosing sensitive information, and which portfolio areas these originated from.

Bunting Costs

Action - Councillor Rogerson to confirm in writing to Councillor Moorcroft the position in respect of the previous Cabinet decision to charge £100 to cover the costs of bunting on the highway, given previously no charge was made.

Community Area Partnerships - Highways Devolved Budgets

Action - Councillor Rogerson to provide a written response to Councillor Alvey on the position in respect of highways devolved budgets for the Community Area Partnerships.

EV Charging Points

Action - Councillor Frost to provide a written response to Councillor German as to whether the BEPS 2 Framework will be able to deliver the charging points within the timescales set out by Government.

Environmental Health Impacts - Seagulls

Action - Councillor Marrington to provide a written response to Councillor Candy in relation to any environmental health impacts relating to issues with seagulls given their protected species status.

Wheelchair Users on Buses

Action - Councillor Rogerson to meet with Councillor Ball to discuss the potential in future for buses in Cornwall to provide more spaces for wheelchair users, as they do in Devon.

Preparedness for Fifth Nation Status

Action - Leader agreed that an economic assessment should be done to consider risks/opportunities in respect of further devolution powers and share with business leaders in due course.

Motion Launceston Cattle Market (Short Stay) Car Park

Action - In accordance with Council Procedure Rule 12.4, the Chairman referred the motion, "Trial Parking Tariff Adjustment - Launceston Cattle Market (Short Stay) Car Park" to the Cabinet as the subject matter was one coming within its functions.

A meeting to be organised with Portfolio Holder, relevant technical officers, proposer, seconder and Chairman of the Council to take next steps.

Response from the Leader - Following a recent meeting with the Cabinet Member for Transport, the Divisional Member for Launceston, and the Member who brought forward the motion on the Trial Parking Tariff Adjustment at Launceston Cattle Market, we have agreed to proceed with a trial to see what effect a change in the parking tariff might have on both parking capacity and income.

This would help us understand whether this approach could work in other parts of Cornwall, especially in places where our usual interventions haven't had the impact we'd like.

Motion Keep Cornwall Clean!

Action - It was resolved that we [Cornwall Council] will continue to work with Clean Cornwall and volunteer community groups across Cornwall to refresh and promote a Duchy-wide litter strategy to keep our beaches, verges and public spaces clean and tidy for One and All to enjoy, all year round.

Response - a meeting was held on 6 November 2025 with Councillors Rich, Mustoe and Frank with Clean Cornwall and key officers. A follow up meeting is arranged for 11 February 2026.

Motion Working to End the Sewage Scandal

Action - It was resolved that:

(i) Council believes Cornwall's natural environment is a precious asset which requires protection for future generations.

(ii) Council shares public concern about sewerage pollution affecting Cornwall's rivers and beaches. Council believes the sewage crisis is a national scandal. It is unacceptable that Water Companies continue to pay their executives millions of pounds in pay, pensions and bonuses while polluting continues.

(iii) Council recognises the scale of the challenge ahead in tackling this issue. Council notes that increased rainfall due to climate change, and government house-building targets will place additional pressure on water infrastructure. Council looks forward to working constructively with South West Water's new CEO when appointed.

(iv) Council therefore: 

a - Instructs the Leader of the Council to write to the new Chief Executive of South West Water to establish urgent commitments and timescales to improve infrastructure and reduce sewage discharges in Cornwall.

b - Ensures that South West Water are engaged in work on the Cornwall Local Plan to ensure that future housing development will have the necessary infrastructure.

c - Instructs the Leader of the Council to convene a water summit bringing together South West Water, environmental charities and community campaigners to work together to improve water quality across Cornwall.

d - Instructs the Leader of the Council to appoint a Water Quality champion from among the membership of this Council.

(v) We ask the legal team to investigate all legal avenues that we can take as an authority to hold South West Water to account.

(vi) We lobby Government to change the bathing season to all year round.

Motion Provision of Mobile Phones or a Second Sim Card to Elected Members

In accordance with Council Procedure Rule 12.4, the Chairman referred the motion, "Provision of Mobile Phones or a Second Sim Card to Elected Members" to the Constitution and Governance Committee because one of its responsibilities was to advise the appropriate Cabinet Member in relation to such Member support, financial and operational issues as may be raised from time to time.

In consultation with the Chairman of the Constitution and Governance Committee, issue to be added to the Committee's work programme.

Action - It was resolved that Council requests the Leader write to the Secretary for Defence, the Secretary of State for Northern Island and Parliamentary Under-Secretary of State (Minister for Veterans and People) asking them to address the health and wellbeing concerns expressed by veterans about the revision of the NI Legacy legislation to ensure that no Northern Ireland Veterans are prosecuted for doing their duty in combating terrorism as part of 'Operation Banner' (1969-2007)

Action - Councillor Frank confirmed that she would raise the matter of puberty blocker trials at the next meeting of the Corporate Parenting Board.

The Chair relayed the question about whether any young people in care are using puberty blockers, prompting a discussion about current regulations and monitoring. Lydia Rawe and Sarah Thayne confirmed that there is an indefinite UK ban on prescribing puberty blockers for gender dysphoria in under-18s, except through approved clinical trials, and that any use outside this would be illegal.

Use of takings from HWRC Shops

Action - Councillor Rich to send info to OSC Members on use of takings from HWRC Shops.

Response - The Kernow Reuse shops at Household Waste Recycling Centres have been set up to ensure that any household items suitable for reuse can be diverted from disposal or recycling, and kept within the local circular economy. Donated items are sold through our network of shops, at affordable prices.

Takings from the sale of reuse items will be used to cover the ongoing operational and running costs of each facility, and to pay back the initial set up costs of each individual shop.

Once the initial set up costs have been paid back (estimated to be approximately 18 months for each shop_, it is expected that the project partners will share revenues, either directly or indirectly through the contract provisions. Discussions regarding this are ongoing.

Helston HWRC parking provision

Action - Councillor Rich to send info to SC Members on Helston HWRC - parking provision and how the ship might affect spaces for others taking waste - risk assessment/capacity details

Response - The Helston Kernow Reuse shop was granted planning permission which included an additional three parking spaces outside the shop building, dedicated for visitors using the reuse shop.

These additional spaces will help ensure that the new facility will not impact on visiting attending site to dispose of recycling and waste. As with any changes to a Household Waste Recycling Centre, risk assessments and traffic management plans are updated accordingly. 

Over the coming weeks, weather allowing, the parking bays outside the reuse shop will be line painted and until this takes place site staff will help direct visitors to park. We would also like to extend an invitation to the local Helston Councillors to visit the Helston Reuse shop for a full tour, please let me know if you would like us to arrange one for you.

Pedestian access to St Erth shop

Action - Councillor Rich to write to Councillor Line whether pedestrian access will be considered for access to St Erth shop as currently the site can only be accessed by vehicle.
