How we will use the information about you

Cornwall Council is required under the Energy Act 2011 to enforce the Minimum Energy Efficiency Standards in the Private Rented Sector introduced by The Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015. The information provided will allow the Council to investigate potential breaches of the Regulations and serve Compliance Notices where appropriate. Failure to comply with the Regulations may result in a financial penalty.

Who has given you my personal data?

Her Majesty’s Land Registry is a public register of land and property ownership which can be accessed to obtain personal data in relation to property ownership, including name and registered addresses of property owners. Private Sector Housing will use this register to obtain personal data for property owners where a breach of the regulations is suspected.

Your personal data may also have been collected from the Revenues Team provided for the billing and collection of Council Tax and/or Business Rates. The Revenues Team share this information to assist with enforcing the Minimum Energy Efficiency Standards under the provisions of the Energy Act 2011.

The Council can also request personal data from other Local Authorities under Schedule 2, Paragraph 5(3)(c) of The Data Protection Act 2018 and from tenants under the Local Government (Miscellaneous Provisions) Act 1976.

If you have registered an exemption in relation to the Minimum Energy Efficiency Standards your information will have been collected directly from this register. Cornwall Council are responsible for maintaining the Private Rented Sector National Exemptions Register for the Minimum Energy Efficiency Standards across the County.

Who else will we share your information with?

We will only use this information in conjunction with the enforcement of Housing Standards including the Minimum Energy Efficiency Standards in the Private Rented Sector. We may share your information with our Cornwall Council departments, such as Trading Standards, Council Tax and Housing Benefit to verify the information that has been provided. We may also share your information with Devon and Cornwall Police to facilitate joint working protocols.

By accessing the landlord liaison service through Community Energy Plus you will also be giving your consent for data to be shared with the Council in relation to your case, as this may form part of the enforcement process. If you are accessing a service via any other third-party organisation, we will only share your data where your consent has been provided.

How we store the information about you

Your data will be held within Cornwall Council’s secure network and premises and will not be processed outside of (the UK/the EEA). Access to your information will only be made to authorised members of staff who are required to process it for the purposes outlined in this privacy notice.

How long will you keep this information for?

Personal information will be kept for 6 years.

What are my data rights?

Your personal information belongs to you and you have the right to:

  • be informed of how we will process it
  • request a copy of what we hold about you and in commonly used electronic format if you wish (if you provided this to us electronically for automated processing, we will return it in the same way)
  • have it amended if it’s incorrect or incomplete
  • have it deleted (where we do not have a legal requirement to retain it)
  • restrict how we process it
  • object to us using it for marketing or research purposes
  • object to us using it in relation to a legal task or in the exercise of an official authority

Why do you need my information?

In order to investigate and resolve breaches in relation to the Minimum Energy Efficiency Standards (MEES). Where breaches are not resolved through informal communications your information may be used to issue a Compliance Notice and/or a financial penalty and ensure recovery of such a financial penalty.
