Care Act appeals guidance notes

Please read these guidance notes, to assist you with completing the online form.

Use this form to tell us why you disagree with the outcome (decision) of your:

  • social care or occupational therapy assessment
  • Care Act eligibility decision, or
  • care and support plan

You must complete this form within four weeks of receiving your completed:

  • Care Act assessment
  • review, or
  • care and support plan

(whichever you are appealing against)

How to complete the form and what happens next

Give us as much information as you can about why you believe we have got the Care Act assessment or the care and support plan wrong.

If you are unsure how to fill in the form, contact our Advocacy service in Cornwall. They can help you tell us what you are unhappy about.

Formal Appeal Process

1. Submit the Appeal

Complete the online appeals form at the bottom of this page.

2. What to Include

Clearly state the decision you are appealing, the reasons for your appeal, and any supporting evidence (such as GP notes or letter etc).

3. Acknowledgment

We will acknowledge receipt of your appeal within five working days of receipt. 

4. Investigation

Once we have received your appeal, an independent panel will look at what you have told us and respond to you within 25 working days. Sometimes it might take longer - we will keep you up to date with what is happening, should this be the case.

If you are appealing against an assessment or review outcome, the panel will look at the new information you have given us. We will either:

  • agree the assessment was correct
  • change the assessment based on the new information and send you a new copy
  • arrange a further assessment

If you are appealing against a care and support plan, the panel will look at the new information you have given us. We will either:

  • agree the support plan was correct
  • change the care and support plan based on the new information and send you a new copy

5. Response

You will receive a written response detailing the outcome of the investigation and any actions to be taken.

6. Escalating the Appeal

If you are not satisfied with our decision, you can escalate the appeal to the Local Government and Social Care Ombudsman (LGSCO).

The LGSCO will conduct an independent investigation and provide a final decision.
