The Council has created a designated list for the purposes of Section 165 of the Equality Act 2010. This list provides details of licensed vehicles which are able to carry passengers in their wheelchairs. Vehicles are only included on this list if it is possible for the user of a *‘reference wheelchair’ to:
- enter
- leave
- and travel
in the vehicle safely and with reasonable comfort whilst seated in their wheelchair.
The vehicles listed are capable of carrying some, but not all types of occupied wheelchairs.
For example: some powered wheelchairs may not be suitable to be safely carried within the vehicles on the below list.
*The meaning of ‘reference wheelchair’ is in Schedule 1 to The Public Service Vehicle Accessibility Regulations 2000
The measurements are as shown in this diagram:
The measurements are:
- 1350mm from floor to top of head
- 150mm from floor to top of foot on foot rest
- 600mm from floor to top of knee
- 700mm wheelchair width
- 1200mm wheelchair length
Please note when creating this list the Council, has relied on the licensed vehicle proprietor making a declaration that their licensed vehicle can carry a ‘reference wheelchair’ with the passenger remaining in the wheelchair if they wish.
The Council may not always have verified this fact.

Licensed drivers of the above designated wheelchair accessible vehicles have the following legal duties:-
- to carry the passenger while in the wheelchair;
- not to make any additional charge for doing so;
- if the passenger chooses to sit in a passenger seat to carry the wheelchair;
- to take such steps as are necessary to ensure that the passenger is carried in safety and reasonable comfort; and
- to give the passenger such mobility assistance as is reasonably required.
The Act defines mobility assistance as assistance:
- to enable the passenger to get into or out of the vehicle;
- if the passenger wishes to remain in the wheelchair, to enable the passenger to get into and out of the vehicle while in the wheelchair;
- to load the passenger’s luggage into or out of the vehicle;
- if the passenger does not wish to remain in the wheelchair, to load the wheelchair into or out of the vehicle.
It is an offence for the driver (unless exempt on medical grounds) to fail to follow the above duties.
Under the Equality Act, vehicle proprietors have the right of appeal against the decision of the Council to include their vehicles on the designated list.
Any appeal must be to the Magistrate’s Court within 28 days of the vehicle being included on the list.
