Luxulyan Parish Neighbourhood Development plan is now formally made. This can be used from 3rd September 2019 as part of the development plan in development management decisions in the Luxulyan Neighbourhood Plan Area. The adopted neighbourhood plan, report and decision notice is available to download below:

 

Luxulyan Neighbourhood Plan Referendum was held on 8th August 2019.The plan was successful at referendum and the result was:

  • Number cast in favour of 'Yes': 234
  • Number cast in favour of 'No': 32

The independent examiner appointed to examine the Luxulyan Neighbourhood Plan was Liz Beth. The documents were sent to the examiner on 13th February 2019 to start the examination.

On 8th May 2019, Cornwall Council received the Examiner's report on the Luxulyan Parish Neighbourhood Development Plan. The Examiner's report concludes that subject to the modifications in the report, the Plan should proceed to referendum. An initial assessment of the neighbourhood plan, background evidence and representations was completed. Following this, the examiner raised a number of initial questions. The questions and responses can be viewed below.

Luxulyan Parish Council has submitted their plan proposal to Cornwall Council for their designated Neighbourhood Development Plan Area, in accordance with the Neighbourhood Planning (General) Regulations 2012 (as amended).

Cornwall Council consulted residents and other interested stakeholders on the plan for the Luxulyan Parish area. The consultation ran between Thursday 20 December 2018 and 7 February 2019 for seven weeks due to the consultation covering the Christmas period.  During the consultation the documents could be viewed on the online planning register, using the Planning number PA18/00022/NDP.

The plan proposal includes a copy of a map and statement which identifies the area to which the proposed Neighbourhood Development Plan relates; a consultation statement; the proposed Neighbourhood Development Plan, a statement explaining how the proposed Neighbourhood Development Plan meets the requirements of paragraph 8 of Schedule 4B to the 1990 Act (the Basic Conditions Statement), Cornwall Council comments on the draft Luxulyan Neighbourhood Plan and an Equality Impact Assessment.

Copies of the documents are available to view at the village shop, Kings Arms Pub, Luxulyan Village Hall and Gunwen Methodist Chapel during the consultation period.

Luxulyan Parish Council applied to Cornwall Council to designate the parish of Luxulyan as a Neighbourhood Area. This was in accordance with the Neighbourhood Planning Regulations 2012.

The Council consulted residents and other interested stakeholders on the designation of this area. The consultation ran between Wednesday 22 June and 3 August 2016. Copies of the applications were available to download from the Online Planning register. (Planning application number PA16/00007/NDP.) The application documents include:
  • a copy of the application letter with a map and
  • a statement that explains how the Parish Council and area meet the conditions of Section 61G(2) of the Town and Country Planning Act (1990) amended by the Localism Act 2011
