Neighbourhood Plan Adopted

The Lanlivery Neighbourhood Development plan is now formally made and can be used from 19 February 2019. This is part of the development plan in development management decisions in the Lanlivery Neighbourhood Plan Area. The Lanlivery NDP Referendum was held on 24 January 2019. The plan was successful at referendum and the result was:

  • Number cast in favour of a 'Yes': 96
  • Number cast in favour of a 'No': 22

The Lanlivery Parish Neighbourhood Development Plan was submitted for examination on 2 May 2018. The independent examiner appointed to carry out the examination is Barbara Maksymiw.

An initial assessment of the neighbourhood plan, background evidence and representations was completed. Following this, the examiner raised a number of questions. These, along with additional information that was requested, are available below:

On 31 August 2018, Cornwall Council received the Examiner's report on the Lanlivery Neighbourhood Development Plan. The Examiner's report concludes that the Plan should proceed to referendum. (This is subject to the modifications outlined in the report.) The examination report and amended Neighbourhood Plan is available to view below:

Lanlivery Parish Council submitted their plan proposal to Cornwall Council on 18 January 2018. This is in accordance with the Neighbourhood Planning (General) Regulations 2012 (amended).

Cornwall Council consulted residents and other interested stakeholders on the plan proposal for the Lanlivery area. The consultation ran from 7 March to 18 April 2018.

The plan proposal included:

  • a copy of a map and statement which identifies the area to which the proposed Neighbourhood Development Plan relates
  • a consultation statement
  • the proposed Neighbourhood Development Plan
  • a statement explaining how the proposed Neighbourhood Development Plan meets the requirements of paragraph 8 of Schedule 4B to the 1990 Act (the Basic Conditions Statement), and
  • an Equality Impact Assessment

Copies of the documents were available to view using the online planning register. (Planning number PA18/00004/NDP.) Hard copies were made available during the six week consultation period at the following locations:

  • Lanlivery Church
  • The Crown Inn, and
  • Lostwithiel Library

Lanlivery Parish Council submitted an application and map to designation their Neighbourhood Area on 8 December 2014. Cornwall Council consulted residents and other interested stakeholders on the designation. The consultation ran from 7 January to 18 February 2015. Documents were made available to view during the six week consultation period. These were available from Lostwithiel Library and Fowey Library and One Stop Shop. The documents included copies of:

  • the application letter
  • a statement that explains how the Parish Council and Neighbourhood Area met the conditions of Section 61G(2) of the Town And Country Planning Act 1990
