This privacy notice sets out the basis by which any personal data we collect from you, or that you provide to us, will be processed by us, in accordance with the General Data Protection Regulations (GDPR) and the Data Protection Act.

We will never sell your personal data, or share it with other Cornwall Council departments.

Adult Education aim to provide adults across the county with opportunities to develop their skills, knowledge, interests and creativity. We are based at Chy Trevail, Beacon Technology Park, Bodmin, PL31 2FR with learning centres throughout Cornwall from Bude in the north to Penzance in the west.

The overall Data Controller for the information you give us when completing an Adult Education application or enrolment form is Cornwall Council, registered address New County Hall, Treyew Road, Truro TR1 3AY and Data Protection Registration Number Z1745294.

Adult Education collects and stores information you give us directly from our enquiry form, paper Adult Education application form, online Adult Education application form and our online Adult Education enrolment form that you complete. We also collect specific data related to any learning support and assistance you require while learning with us.

The personal information we collect about you can include:

  • your name, date of birth, address, email, ethnicity, nationality
  • information about disabilities or learning difficulties
  • employment status, eligibility to any benefits, annual salary
  • existing qualifications
  • your closest town

Your information will be used to check your eligibility for funding and meet our contractual requirements with the Education and Skills Funding Agency (ESFA).

The information also allows us to undertake accurate assessments and reviews of your education and learning support needs. This ensures that you receive the learning and support services best suited to your needs and circumstances. It also helps us to monitor and improve our services.

The information you supply is used by the Learning Records Service (LRS). The LRS issues Unique Learner Numbers (ULN) and creates Personal Learning records across England, Wales and Northern Ireland, and is operated by the Education and Skills Funding Agency, an executive agency of the Department for Education (DfE). We will use the marketing information you give us to send you emails about adult education courses in your local area.

We regularly review how long we keep your personal information. Where your data is required for legal or contractual purposes we will keep your information in line with these requirements.

Currently, we intend to hold your personal marketing preferences for up to three years after you enrol on an Adult Education course or after you have completed an Adult Education application form. This will be the case unless you ask us to delete your information from our records before that time. Please see the How do I opt out? and Your Rights sections below for details on how to view, amend or delete your personal data from our records.

We won’t sell or rent your information to third parties or share it with other Cornwall Council departments for marketing. We may share your information with colleagues within the Council if this is necessary to enhance the support we provide or where we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

Where Adult Education shares data with a third party who undertakes work for us, Adult Education requires that the sharing is undertaken under contract and is subject to a data sharing agreement, specifying the secure management of the data.

We do transfer your information outside the European Economic Area to a third-party data email platform in the US that processes your data for us.

We only give them the minimum information necessary in order to deliver the e-newsletter to you and we have a legal agreement in place with them that requires them to keep your information secure and not to use it for their own direct marketing purposes.

We will not contact you again by email, phone or text message for marketing purposes unless you renew your prior consent.

Your personal information belongs to you and you have the right to:

  • be informed about how we will process it
  • request a copy of what we hold about you and in commonly used electronic format if you wish (if you provided this to us electronically for automated processing, we will return it in the same way)
  • have it amended if it’s incorrect or incomplete
  • have it deleted (where we do not have a legal requirement to retain it)
  • withdraw your consent if you no longer wish us to process your information
  • restrict how we process it
  • object to us using it for marketing or research purposes (if it is used for this purpose)
  • object to us using it in relation to legal tasks or in the exercise of an official duty
  • request that a person reviews an automated decision where it has had an adverse effect on you

You can ask to view, delete or correct any personal data Cornwall Council Communications Team holds about you at any time, and under new data regulation laws we must comply with your request within 21 days.

You will need to make your request to view, amend or delete your personal data in writing, either by email to dpo@cornwall.gov.uk, or letter to Data Protection Officer Simon Mansell, New County Hall, Treyew Road, Truro TR1 3AY.

If you find the information we hold about you is inaccurate, or you’d like us to delete your details altogether, please write to us and tell us, either by email at cornwallcouncil@cornwall.gov.uk, or by letter to Cornwall Council Communications Team, 4S, County Hall, Truro, TR1 3AY.
