You are signing up to Cornwall Council’s online Residents’ Panel using a third party system which is outside of the European Union and as such has different laws on how your data is stored. The third party is committed to an international framework where data is secured to the same or higher standards of the European Union and information will only be used for Cornwall Council and will never be sold or used by any other third party.

Cornwall Council Residents’ Panel privacy policy

Cornwall Council is committed to protecting your privacy and security. This policy sets out how and why we use your personal data to keep you informed and in control of your information.

From May 2018, Cornwall Council is asking residents to ‘opt-in’ in for marketing communications. This is owing to a change to the rules that govern how we can communicate with you and a new regulation on personal data (the General Data Protection Regulation) that came into force in May 2018.

Therefore, we are introducing a new approach that asks you to actively give your consent about how we can contact you.

We will never sell your personal data, or share it with other Council departments .

Who are we?

Cornwall Council’s Resident Panel is an online service operated by Cornwall Council’s Communications Team, based at County Hall, 4S, County Hall, Truro, TR1 3AY.

The overall Data Controller for the information you give us when signing up for this e-newsletter is Cornwall Council, registered address New County Hall, Treyew Road, Truro TR1 3AY and Data Protection Registration Number Z1745294.

How do we collect information from you?

Cornwall Council’s Residents’ Panel collects and stores information you give us directly via the Residents’ Panel email subscription form on the Cornwall Council website.

What type of information do we collect from you?

The personal information we collect about you can include:

  • your name and email address for sending you emails and e-newsletters
  • your IP address, operating system and browser type for administration purposes and to produce internal reports,
  • the date and time you subscribed to Your Cornwall so we comply with the new General Data Protection Regulation , and
  • your location, so we can tailor content to your local area.

 

How is your information used?

We will use the information you give us directly on the Residents’ Panel sign up form to send you information about Council consultations and surveys and engagement events.

We may also use your information to:

  • present the content of emails in the most efficient way for you and the computer you are using,
  • enable you to use any interactive features of the emails and surveys,
  • send you information that relates to Cornwall Council consultation opportunities and engagement events,
  • seek your views or comments on services we provide,
  • to create a profile of your interests and preferences so we can make our consultation emails more relevant to you.

Use of cookies

Like other organisations, we also gather information from you indirectly through the use of ‘cookies’ on the Cornwall Council website. Cookies are small pieces of information sent by a business’ or organisation’s website to your computer and stored on your hard drive to allow that website to recognise you when you next visit. Cookies are used to improve a website visitor’s online experience. They collect statistical data about your browsing actions and patterns but do not identify you as an individual.  Using cookies helps us to improve our website, deliver effective communications and offer you a more personalised service.

You can switch off cookies by adjusting your browser preferences or using a dedicated browser extension.

How long will we hold your data?

We regularly review how long we keep your personal information. Currently, we intend to hold your data for up to two years after your last engagement with the Residents’ Panel, by which we mean you opening am email from us, unless you ask us to delete your information from our records before that time. Please see the How Do I Opt Out and Your Rights sections below for details on how to view, amend or delete your personal data from our records.

Who else has access to your information?

We won’t sell or rent your information to third parties or share it with other Cornwall Council departments for marketing, or any other purposes, unless we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

We do transfer your information outside the European Economic Area to a third-party data email platform in the US that processes your data for us.

We only give them the minimum information necessary in order to deliver the e-newsletter to you and we have a legal agreement in place with them that requires them to keep your information secure and not to use it for their own direct marketing purposes.

How do I opt out?

You can unsubscribe from the Residents’ Panel at any time using the ‘unsubscribe’ button on Panel emails. We will stop sending you Residents’ Panel emails unless you actively choose to opt back in by filling in the resubscription form. If, later on, you no longer want to be part of the Residents’ Panel you can unsubscribe in one of two ways:

  • Click the ‘unsubscribe’ or ‘change preferences’ link at the bottom of any of Panel emails sent to you.
  • Or, email haveyoursay@cornwall.gov.uk and we will aim to process your request within 7 days.

We will not contact you again by email, phone or text message for marketing purposes unless you give your prior consent.

What are my data rights?

Your personal information belongs to you and you have the right to:

  • be informed of how we will process it,
  • request a copy of what we hold about you and in commonly used electronic format if you wish (if you provided this to us electronically for automated processing, we will return it in the same way),
  • have it amended if it’s incorrect or incomplete,
  • have it deleted (where we do not have a legal requirement to retain it),
  • withdraw your consent if you no longer wish us to process your information,
  • restrict how we process it.

How do I view, correct or delete my personal data?

You can ask to view, delete or correct any personal data Cornwall Council Communications Team holds about you at any time and under new data regulation laws we must comply with your request within 21 days.

You will need to make your request to view, amend or delete your personal data in writing, either by email to dpo@cornwall.gov.uk, or letter to Data Protection Officer Simon Mansell, New County Hall, Treyew Road, Truro TR1 3AY.

Correcting inaccurate information or deleting your personal data

If you find the information we hold about you is inaccurate, or you’d like us to delete your details altogether, please write to us and tell us, either by email at haveyoursay@cornwall.gov.uk, or by letter to Cornwall Council Communications Team, 4S, County Hall, Truro, TR1 3AY.

What if I have a complaint?

If you think we’ve got something wrong, please do write and tell us, so we can try to put things right. However, if you are unhappy with the way we have processed your information or how we have responded to your request to exercise any of your rights in relation to your data, you can raise your concerns direct with the Information Commissioner's Office (ICO).

The ICO is the UK's independent authority set up to uphold information rights in the public interest and you can raise your concern by telephone on 0303 123 1113, or by raising your concern online here.
