Closing submissions for the CERC Inquiry have been held in the
Council Chamber at the St Austell One Stop Shop, 39 Penwinnick
Road, St Austell PL25 5DR. The Closing Statements that

A further Procedure
Note has been issued by the Planning Inspector in terms of
procedural and administrative arrangements relating to the
inquiry.
The Council has recently
written to all owners and occupiers of property near the
site and other interested parties to notify of the arrangements for
the inquiry.

Procedure
Note 1 dated 14 January 2010 The purpose of the Procedure
note is to establish the procedural and administrative arrangements
for the Inquiry, including the submission of evidence.
Procedure
Note 2 dated 31 January 2010 The purpose of this further
note is to clarify some of the points that have arisen since the
first procedural note (please see above).
The Planning Inspectorate confirmed the nominated
inspector to hold the Inquiry. The sitting days for the
Inquiry was revised to 24 days.
Appeal programme set:
The Planning Inspectorate set a timetable
for the appeal and confirmed other details relating to the
appeal process.
A copy of the letter from the Environment
Agency dated 15 October 2009 to Sita requesting further
information to support the application for an Environmental Permit
(please contact the Environment Agency direct for queries relating
to the permit process (Customer Services 08708
506506).
A copy of the letter from the Planning
Inspectorate dated 9 October 2009 confirming the Secretary of
State has directed that they shall determine the appeal.

Background
The planning application for the CERC was first submitted to the
former Cornwall County Council in March 2008. The planning
application was subsequently refused planning permission by the
County Council’s Planning (Development Control) Committee at their
26 March 2009 meeting.

Appeal
SITA Cornwall Ltd formally lodged an appeal with the Planning
Inspectorate against the refusal of planning
permission.
